How to Enter:
Beginning December 24, 2009 at 12:01 AM (EST) through April 30, 2010 at 11:59 p.m. (EST), go to www.SOBeFiTmagazine.com, upload an original full body picture of yourself and complete and submit the entry form pursuant to the instructions on-screen. By submitting an entry, each contestant agrees to these Official Rules of the contest and all other terms and conditions governing the contest.
Submission Requirements:
Submission must be an original writing by the entrant and an original picture taken of the entrant. No stock or professional photos may be used. Pictures may not be digitally altered or modified in any way. Any entry, which in the sole opinion of SOBeFiT Magazine (the “Sponsor”) is deemed to be inappropriate for publication will be deemed ineligible. Once a picture is submitted, it cannot be changed, altered or modified. Picture and writing (a) must be the original and sole creation of, and all right, title and interest, including, but not limited to, the copyright in the picture and writing must be owned solely by the entrant; (b) may not have been submitted in any other competition; (c) may not have been published; (d) may not infringe upon any third party’s right, including but not limited to copyright, patent or trademark, or right of privacy or publicity, or contain material that is or may be considered defamatory, slanderous or libelous, or portray in a false light; (e) may not violate any law, rule or regulation Each entrant warrants and represents that his or her picture and writing complies with all of the aforementioned conditions. Pictures and writings that do not comply with these conditions will be subject to disqualification. Entries cannot contain the trademark, trade name or logo of any third party and cannot contain any material that is protected by copyright. By entering, entrants grant the Sponsor a royalty-free, world-wide, perpetual, non-exclusive license to display, distribute, reproduce and create derivative works of the entries, in whole or in part, in any media now existing or subsequently developed, for any purpose, including, but not limited to, Sponsor’s publications, advertising promotion and publicity of the contest. Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such uses. All submitted entries become the property of the Sponsor and will not be acknowledged or returned.
Judging:
Phase I: Selection of Top Six Semifinalists.
All entry forms will be judged by a panel of Judges. The Judges will narrow all entries to the top six semifinalists (three female and three male) at their sole discretion, based on the Criteria.
In order to be eligible to continue, the finalists will be required to sign necessary documents, including releases. Any finalist who is unwilling or unable to sign the necessary documents will be automatically disqualified. Sponsor reserves the right to submit the finalists to drug tests, fitness, wellness and nutritional assessments, or any other assessment reasonably required to confirm or otherwise verify information contained in the finalists’ questionnaires, including checking references and/or participation in sports or community activities.
Phase II: Selection of the Grand Prize Winners.
One Male Grand Prize Winner and One Female Grand Prize Winner (collectively the “Winners”) shall be selected by a simple majority of votes, submitted online by the general public at www.sobefitmagazine.com. The Voting Period shall be announced at a later date in the Magazine and on the Magazine’s website. During the Voting Period, members of the general public may cast a one-time vote for one male contestant and for one female contestant of his or her choice. Submission of an online vote constitutes agreement to the terms and conditions of SOBeFiT’s website and certification that only a one-time vote is being cast for one male contestant and for one female contestant. In the event of a tie, the Winners shall be selected by the Judges, at its sole discretion.
Eligibility:
Open to legal residents of the United States ages 18 and older. Void where prohibited by law. Employees of Sponsor, its parent corporations, affiliates and subsidiaries, participating advertising and promotion agencies, and prize suppliers, and members of their immediate family and/or those living in the same household of each such employee are not eligible. Proof of residency and age shall be required prior to participation.
Prizes and Approximate Retail Values:
Two winners (one female and one male) will be selected. Each winner will receive an original, custom-designed Romero Britto sculpture, a feature spread in the Magazine and an event held in their honor (total estimated retail value of each prize is $33,000.00). Each winner will be required to provide an IRS Form W-9 and will be given an IRS Form 1099, based on the value of the prize.
Conditions of Participation:
Entrants agree to be bound by the terms of these Official Rules and by the decisions of the Sponsor and Judges, which are final and binding on all matters. Each prize is awarded “as is” with no warranty or guarantee, either express or implied. No transfer, assignment or substitution of a prize is permitted, except that Sponsor reserves the right to substitute a prize for an item of equal or greater value in the event an advertised prize is unavailable. All federal, state, provincial and local laws and regulations apply. Semifinalists, finalists and winners will be required to sign and return an Affidavit of Eligibility, a Liability Release, Informed Consent for Wellness Assessment, Drug Test Consent Form, Model Release, Interview Release, a Publicity Release (where legally permissible) and any other documents required by Sponsor within 7 days following the date of first attempted notification or the designation or prize, whichever is applicable, will be awarded to an alternate winner based on the Criteria. If any prize notification or any prize is returned as undeliverable, the prize will be awarded to an alternate winner based on the Criteria. Semifinalists, finalists and winners hereby further agree that they will sign any documents necessary to transfer copyright of the entry to Sponsor within 7 days following the date of first attempted notification. Failure to comply with these deadlines may result in forfeiture of the prize and selection of an alternate winner. Semifinalists, finalists and winners must be available for various press appearances and meetings, including photo shoots, award ceremonies and engagements. Acceptance of the prize constitutes permission for Sponsor and its agencies to use winner’s name and/or likeness, biographical information and/or entry (including an altered form of the entry) for advertising and promotional purposes without additional compensation, unless prohibited by law. By accepting the prize, winner agrees to hold Sponsor, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representative agents, successors, assigns, officers, directors and employees harmless for any injury or damage caused or claimed to be caused by participation in the contest or acceptance or use of the prize. Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize. Sponsor shall not reimburse any expenses incurred on behalf of the entrants, semifinalists, finalists or winners, unless Sponsor specifically agrees to do so in writing, at Sponsor’s sole discretion. All information gathered from the entrants, semifinalists, finalists and winners shall be the sole property of the Sponsor.
Internet:
Sponsor is not responsible for lost or late entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. Sponsor reserves the right to disqualify any individual who tampers with the entry process. Sponsor may prohibit an entrant from participating in the Contest if it determines that the entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception or other unfair practices. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right to cancel, terminate, modify or suspend the Contest.
